ABSTRACT

The present work have how principal objective the study of the institution of penal transaction, established by law the Special Criminal Courts, as well as, the consequences of its implementation of the sentence imposed is not justifiable in the criminal transaction with the searching, was addressed the procedural history and the necessity of Special Criminal Courts, which is oriented by principles of orality, cerelity, informality, simplicity and economy of procedure. After the searching show the rite of procedural law, that happens with preliminary phase, the audience, the civil composition damages abs especially the institute of criminal transaction and their way of application. Finally the research analyzed the consequences of not complying with the sentence imposed in the criminal transaction and the possibility of convention of sentence in prison. The study demonstrated that have controversy in doctrine and jurisprudence, as to the procedure adopted in case of unjustifiable of the benefit.
